Heard counsel for the petitioner, Sri R.P. Dubey appears for respondent no. 2. Learned standing counsel appears for the respondents No. 1 and 3.  No notice is being issued to the respondent no. 4 in view of the order which is being passed .

The petitioner's case is that he was selected by the U.P. Secondary  Education Service Selection Board for appointment as Lecturer in Sanskrit and  the name of the petitioner was sent for posting to the Committee of Management, J.B.S. Hindu Kanya Inter College, Saharanpur - respondent no.4 but he was not  permitted to join. The District  Inspector of Schools  has written letter dated 17.5..2005 to the Secretary, U.P. Secondary Education Service Selection Board that the petitioner cannot be permitted to join and he be adjusted to some other institution.  Learned counsel for the petitioner contended  that rule 13 (5) has been substituted by the  U.P. Secondary  Education Service Selection Board (Second Amendment)  Rules, 2007 with effect from 23.1.2007 in accordance with that  the petitioner can be adjusted to some other institution.

Considering the facts of the case ends of justice be served in disposing of the writ petition directing the respondents to consider the case of the petitioner in accordance with the amended rule 13(5) of the  U.P. Secondary  Education Service Selection Board (Second Amendment)  Rules, 2007. and in the light of the letter dated 17.3.2005 of the District  Inspector of Schools  Annexure-2 to the writ petition   expeditiously preferably within a period of two months from the date of production of a certified copy of this order.

With the above observations the writ petition is disposed of.
