The petitioner whose licence of Fair Price Shop has been cancelled, has filed this petition for a direction upon the respondents not to make fresh allotment of Fair Price Shop till the disposal of the Stay Application filed by him before the learned Commissioner in the appeal against the order of cancellation of Fair Price Shop.
Learned counsel for the petitioner submitted that at present there is no Commissioner in the Bareilly Division and, therefore, this Court should grant some protection to him.
Learned Standing Counsel has stated that in the absence of the Divisional Commissioner, the First Additional Divisional Commissioner may be asked to decide the application.
In view of the aforesaid, we dispose of the Writ Petition with a direction that the First Additional Divisional Commissioner shall decide the appeal filed by the petitioner expeditiously preferably within a period of two weeks from the date a certified copy of this order is produced by the petitioner before him.
