Heard counsel for the petitioner and the learned standing counsel. No notice is being issued to respondent no. 4. Liberty is reserved to the respondents No.4 to move an application for revocation, clarification, variation and modification of the order if they feel so aggrieved.
The only prayer pressed by counsel for the petitioner in this writ petition is that the representation of the petitioner submitted to the Committee of Management claiming promotion on the post of Lecturer (Civics) be directed to be considered and appropriate steps be taken by the Committee of Management. The petitioner's case in the writ petition is that due to retirement of Ramanand Sharma on 30.6.2006 a post of Lecturer (Civics) fallen vacant which, according to the petitioner, is under promotional quota. Petitioner claimed to be eligible for the post of Lecturer (Civics). The question as to whether the post which has fallen vacant is of promotional quota and further who is Assistant Teacher entitled for promotion are questions of facts which are first to be considered by the Committee of Management. Petitioner has already represented the Committee of Management claiming promotion, copy of which has also been filed as Annexure-4 to the writ petition.
Considering the facts of the case ends of justice be served in disposing of the writ petition directing the Committee of Management to consider and take appropriate decision on the claim of the petitioner seeking promotion. It will be open for the Committee of Management to consider the case of all eligible persons in case the post fallen vacant is under promotional quota.
With the above observations the writ petition is disposed of.
