Prayer for bail has been on behalf of the appellants who have been convicted vide judgment and order dated 1.6.2007 passed in S.T. No. 55 2005 by Additional District Judge//Fast Track Court No. 2, Firozabad.
Heard learned counsel for the appellant and learned A.G.A. for the State and perused the lower court record and the order of Sessions Judge.
It is submitted by learned counsel for the appellant that it was a case of sudden quarrel. Initially according to the prosecution case, two persons were alleged to have assaulted the deceased but the post mortem examination report indicates solitary injury. The role of assault was assigned to appellant Heerendra Yadav. The appellants were on bail during the trial and they did not misuse the liberty.
Considering the facts and circumstances of the case, the appellants are admitted to bail.
Pending appeal the appellants Heerendra Yadav and Surendra Yadav convicted in S.T. No. 55 of 2005 shall be released on bail on their each executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realisation of fine shall also remain stayed.
