Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for quashing the order dated 18.7.2007 passed by the District Inspector of Schools. Petitioner's case in the writ petition is that the petitioner is senior most class IV employee who has claimed for promotion on the post of clerk. By letter dated 18.7.2007 the District Inspector of Schools has called for a report on the complaint made by Brijendra Singh another class IV employee who is claiming promotion as Scheduled Caste candidate. The letter dated 18.7.2007 is letter by which only report has been called. There is no determination by the District Inspector of Schools himself regarding the claim. The writ petition filed by the petitioner is premature. It is open for the Management to submit reply to the letter. It is also open for the petitioner to represent his case before the District Inspector of Schools. It goes without saying that the resolution passed by the Committee of Management in favour of the petitioner shall also be considered by the District Inspector of Schools before taking any decision for promotion.
Subject to the above observations the writ petition is dismissed.
