Prayer for bail has been on behalf of the appellant who has been convicted vide judgment and order dated 28.11.2006 passed in S.T. Nos. 557 of 2005 and 646 of 2005  by Sessions Judge, Meerut.

Heard learned counsel for the appellant and learned A.G.A. for the State and perused the lower court record and the order of Sessions Judge.

According to the prosecution case the main role of firing has been assigned  to the appellant and post mortem examination report corroborates the eye witnesses. The appellant was not on bail during the trial.

Considering the facts and circumstances of the case, the appellant is not entitled to be released on bail.

Prayer for bail on behalf of the appellant is rejected.

Office is directed to prepare the paper book and list this appeal for final hearing at an early date.
