Prayer for bail has been on behalf of the appellant who has been convicted vide judgment and order dated 1.6.2007 passed in S.T. No. 55 2005 by Additional District Judge//Fast Track Court No. 2, Firozabad.
Heard learned counsel for the appellant and learned A.G.A. for the State and perused the lower court record and the order of Sessions Judge.
It is submitted by learned counsel for the appellant that it was a case of sudden quarrel. Initially according to the prosecution case, two persons were alleged to have assaulted the deceased but the post mortem examination report indicates solitary injury. The role of assault was assigned to co-accuised Heerendra Yadav. The appellant was on bail during the trial and he did not misuse the liberty.
Considering the facts and circumstances of the case, the appellant is admitted to bail.
Pending appeal the appellant Yogendra Singh convicted in S.T. No. 55 of 2005 shall be released on bail on his executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realisation of fine shall also remain stayed.
