Appellant Mangla Yadav has prayed for release on bail in criminal appeal no. 4627 of 2007 filed by him against the judgement and order dated 10.7.2007 passed by Additional Sessions Judge (F.T.C. No. 1), Mirzapur in Sessions Trial Nos. 81 of 2003, 241 of 2003 whereby the appellant has been found guilty and convicted under Sections 307/34, 323/34 IPC and sentenced to undergo rigorous imprisonment up to seven years and fine has also been imposed on him with default stipulation.

Heard learned counsel for the parties and perused the material on record.
Contention of learned counsel for the appellant is that accused is alleged to have given hockey blows to the injured Heera lal but the injury was found to be simple according to medical report. Co accused Mauji Lal is alleged to have caused firearm injury but at present he is not the appellant.
Considering the facts and circumstances of the case but without prejudice to the merits of the case, the accused be released on bail during the pendency of the appeal on his furnishing a personal bond with two sureties each of like amount to the satisfaction of the court concerned and also on depositing the one forth of the amount of fine as imposed on him and the balance three forth amount of fine shall remain stayed during the pendency of the appeal.
