Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. but during investigation after 15 days of the alleged occurrence the name f the applicant came to light as an accused. The evidence of extra judicial confession have been made. It is said that two silver bangles were recovered from the possession of the applicant which was not given in the list of the looted articles. The co-accused Amroo alias Amar whose case was on the same footing has been released on bail by this court on 9.11.2006 in criminal misc. bail application no. 23934 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Shyamu alias Vir Singh involved in case crime no. 341 of 2006 under Sections 396,412 I.P.C., P.S. Kalyanpur District Kanpur Nagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
