  Heard learned counsel for the applicant and the learned A.G.A.

        It is submitted by learned counsel for the applicant that the applicant is the husband of the deceased. The deceased committed suicide and his dead body was found inside the room. It was taken out after breaking the door of that room. The information of death was given by Pramod Chaudhary by telephonic message to the police station concerned on 25.6.2006. On that information inquest report was prepared. At that time the first informant and other members of family of the deceased were present there but they did not make any objection. Thereafter on 28.6.2006 at 10.05 a.m. the present F.I.R. has been lodged. The suicide note was recovered by the I.O. on 25.6.2006 from the same room where the dead body was found in which no allegation was made in respect of the demand of dowry and cruelty. It is contended that prior the alleged occurrence the deceased has made at attempt to commit suicide because she was having illicit relation with the brother of her brother in law.

In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.

Let the applicant Tejveer    involved in case crime no. 378 of 2006  under Sections 498-A/304B I.P.C., and ¾ D.P. Act  P.S. Jhinjhana District Muzaffarnagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
