Heard learned counsel for the applicant.
The applicant alleges non-compliance of the order dated 3.4.2007. The contention of the applicant is that inspite of the order dated 7.2.2007 being stayed by this Hon'ble Court, he has not been paid wages which is given to a regular workman and that he is being paid the wages payable to a Muster Roll employee.
In my opinion, no case for contempt is made out. The mere fact, that the order dated 7.2.2007 has been stayed does not mean, that the applicant would be entitled to payment of regular wages. A specific order is required to be obtained from the Writ Court before proceeding in contempt proceedings for non-payment of regular wages can be initiated.
Consequently, in the opinion of the Court no case for contempt is made out against the opposite party. The contempt application is dismissed.
