Heard learned counsel for the petitioners and learned A.G.A. for the State.
This petition has been filed by the petitioners for quashing of the first information report lodged at case crime No. 127 of 2007 under Section 364, 342, 504, 506 I.P.C., P.S. Manda, District Allahabad.
The allegation made in the First Information Report is that the informant was abducted from her house on 05.01.2006 and report was lodged on 20.07.2007.
The counsel for the petitioner submits that no offence under Section 364 I.P.C. is made out and on the basis of averment made in the First Information Report, the offence under Section 342 I.P.C. only is made out.
From the bare perusal of First Information Report, it cannot be said that no cognizable offence was made out.
The writ petition is dismissed.
However, it is directed that in case the petitioner surrenders and applies for bail within ten days from today before the Magistrate concerned in the aforesaid case, the same shall be considered and disposed of expeditiously in accordance with law considering the submissions made herein-above by the learned counsel for the petitioners.
