Learned counsel for the complainant respondent submits that the final report has already been filed in this case. Certified copy of the same has been produced. On 23.7.2007 also, the same submission was made from the respondent's side and the same certified copy had been produced and learned counsel for the petitioner had been granted time to verify.
It is being stated by the learned counsel for the petitioner that final report has in fact been submitted. However, despite this, he wants the first information report to be quashed on the ground that the complainant may chose to institute a criminal complaint by filing a protest petition.
If any such thing has been done that would amount to a fresh cause of action against the complaint procedure adopted by the Magistrate. The writ petition as far as we understand does not survive after submission of final report, and there remains no action either for quashing the first information report or for continuing the stay.
The writ petition is accordingly dismissed.
Interim order dated 9.10.2006 is vacated.
