Heard learned counsel for the petitioners and learned A.G.A. for the State.

Perused the allegations of the First Information Report.

Issue notice to respondent no. 3, who may file counter affidavit within four weeks.  Learned A.G.A. may also file counter affidavit within the said period. Rejoinder affidavit, if any, may be filed within two weeks thereafter.

List thereafter.

Till the next date of listing or till submission of charge-sheet whichever is earlier, the arrest of the petitioners namely Ram Singh, Ramesh Singh and Nimendra Singh, involved in case crime No. 551 of 2007 under Sections 406, 420, 323, 504, 506 I.P.C. P.S. Fatehganj(West), District Bareilly shall remain stayed provided they co-operate with the investigation.
