The petitioner is a plaintiff-respondent in a pending appeal. An application for appointment of a survey commission was made by the petitioner  which has been dismissed by the appellate court. It has been observed that the application was made with an intent to delay the proceeding in the appeal. I am not inclined to interfere with the order at this stage. It is open to the petitioner to raise the question about the validity of the order of the appellate court in the second appeal against the decree of the appellate court. The petition is dismissed.
