It is stated by Sri R.S. Misra, counsel for the petitioner as well as by Sri Rajesh Kumar counsel for respondent no.3 that controversy involved  in this case is identical to that of writ petition no. 19462 of 1988 decided on 9.5.2007 and this petition may be disposed of on the same terms with the modification that in view of the change of jurisdiction the case has now to be heard by CJM Sant Ravidas Nagar instead of CJM Varanasi.

In view of the statement made by the counsel for both the parties this writ petition is decided in terms of the decision in  writ petition no. 19462 of 1988 Ashok Kumar Vs. Chief Judicial Magistrate, Varanasi and others only with the modification that the case may now be decided by Chief Judicial Magistrate, Sant Ravidas Nagar instead of Chief Judicial Magistrate, Varanasi.
