A prayer for bail has been made on behalf of the appellant, who has been convicted by the judgement and order dated 15.07.2006 passed by Additional District & Sessions Judge, Court No. 14, Ghaziabad in S.T. No. 320 of 1998 (State Vs. Lala @ Tejpal & another) .
Heard learned counsel for the appellant, learned A.G.A. for the State of U.P. and also perused the order of Sessions Judge as well as the lower Court record.
It is submitted by learned counsel for the appellant that in the First Information Report, accused was not named. The occurrence took place on 13.09.1993 and name of the appellant was disclosed by the eyewitness on 06.10.1993. Counsel for the appellant submits that name of the appellant has been introduced after consultation and deliberation. It is further submitted that co-accused has already been released on bail. The appellant was also on bail during trial and he did not misuse the liberty of bail.
Considering the facts and circumstances of the case, let the appellant be released on bail.
Pending appeal, the appellant Tejpal @ Lala S/o Jullan Singh be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned.
Till further orders, realization of fine shall also remain stayed.
