It is submitted by the petitioners' counsel that a suit for injunction was filed by the petitioners restraining the defendants who are co-tenants of the disputed plot from interfering in the joint possession of the petitioners and from making constructions and in the said suit an application for temporary injunction was also filed on which the trial court has issued notice but did not grant any ex parte temporary injunction. The petitioner filed a revision, which to has been dismissed. It is stated that the next date fixed in the suit is 7.9.2007 and that it is apprehended that the respondents shall make constructions over the disputed land even before the next date fixed.
In the facts and circumstances it appears to be appropriate that the parties shall maintain status quo until the disposal of the application for temporary injunction. Counsel for the petitioner states that the petitioner will not take any adjournment.
The writ petition is disposed of with the direction that the parties shall maintain status quo until the disposal of the injunction application. It is made clear that the trial court shall dispose of the injunction application on merits on the basis of the material before it after giving opportunity of hearing to the respondents without being influenced by this order.
