The only prayer pressed by counsel for the petitioner is that the application under Order 9, Rule 13 CPC for setting aside an ex parte decree which was filed in the year 2004 is pending and is not being disposed of on account of dilatory tactics of the respondents and the trial court may be directed to dispose of the application expeditiously and within a time bound period. In the facts and circumstances, this writ petition is disposed of with the direction to the trial court to dispose of the application under Order 9, Rule 13 CPC expeditiously and if possible within four months.
