A prayer for bail has been made on behalf of appellants who have been convicted by Additional Sessions Judge, Fast Track Court No. 4, Etah vide judgement and order dated 4.2.2006 in S.T. No. 688 of 1999 and sentenced them to imprisonment for life and a fine of Rs. 5,000/- each.
Heard learned counsel for the appellants and the learned A.G.A. for the State and perused the order of Sessions Judge and lower court's record.
It is submitted by learned counsel for the appellants that there was cross case and both side had sustained injuries in the incident. The appellants were on bail during the trial and they did not misuse the liberty. It is further contended that the deceased was not died on the spot.
Considering the facts and circumstances of the case, the appellants are admitted to bail.
Pending appeal, appellants Babu Ram, Arman Singh, Sandeash Singh and Khanjan Singh convicted in S.T. No. 668 of 1999 shall be released on bail on their each executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine shall also remain stayed.
