Present writ petition has been filed, questioning the validity of order dated 13.07.2007 passed by Commandant, 9th Battalion, P.A.C., Moradabad. Ground disclosed for passing aforementioned order is that wrongful disclosure had been made by the petitioner in the affidavit, which was detected at the time of character verification. At the point of time when writ petition was presented on 25.07.2007, petitioner made categorical statement that at no point of time, he was arrayed as accused in case crime No.55 of 2004 under Sections 323, 504 and 506 I.P.C. , police station Bakewar, District Etawah, and the opinion, which has been formed by the authority concerned, that there has been concealment of fact, is based on totally wrong presumption, as such impugned order is liable to be quashed.

On this statement being made, learned Standing Counsel was asked to obtained instructions in the matter and to produce relevant record.

Today on the matter being taken up, record in question has been produced, and on the basis of record so produced, learned Standing Counsel concedes that at no point of time, petitioner was arrayed as accused in case crime No.55 of 2004 under Sections 323, 504 and 506 I.P.C. , police station Bakewar, District Etawah, and thus there was no concealment on his part. Thus, it is writ apparent that the opinion formed by the Commandant, 9th Battalion, P.A.C., Moradabad was totally wrong, and the same has caused lot of sufferings to petitioner, inasmuch as, in these days to get employment is question of life and death, and such casual approach is deprecated,  in cancelling appointment.

Since the petitioner has been put to mental agony, writ petition is being allowed, a cost  of Rs.10,000/-(Rupees Ten Thousand only) is being imposed, which is to be paid by Bhajni Ram Mina, Commandant, 9th Battalion, P.A.C., Moradabad to petitioner within one month from today.
