The counsel for the petitioners submits that suit for restitution of conjugal rights was filed by petitioner No. 1 against respondent no. 3 prior to the lodging of the F.I.R. in question which is actually a counter blast of the above suit.
Notice on behalf of respondents no. 1 and 2 has been accepted by the learned A.G.A. Notice on behalf of respondent no.3 has been accepted by Sri Anupam Laloria. They pray for and are granted one month's time to file counter affidavit. Rejoinder affidavit may be filed within three weeks thereafter.
List this petition for admission after expiry of the aforesaid period.
On the next date of listing complete name of Sri Anupam Laloria may be printed in the cause list.
In the meantime, investigation may be continued but the petitioners will not be arrested in case crime no.233/2007 under sections 323, 504, 506 and 498-A I.P.C. and section ¾, Dowry Prohibition Act police station Barra district Kanpur Nagar till the next date of listing or till submission of the police report under section 173 Cr.P.C., whichever is earlier.
