Heard learned counsel for the petitioner Sri Arvind Upadhyay and Sri V.K. Chandel for the respondents.

The petitioner earlier filed a writ petition no. 53152 of 2004. The same was decided by this Court on 14.12.2004 by the following order:

"Heard Sri Arvind Upadhyay, learned counsel for the petitioner, Sri H.N. Singh learned counsel for the respondent No.4.

The moment petitioner deposits a sum of Rs.30,000/- with the respondent no.4, the respondents no. 1 to 3 shall release the petitioner from civil imprisonment immediately, and thereafter in case the petitioner deposits a sum of Rs.1,70,000/- with the respondent no.4 within 2 months from today and makes a representation within two weeks, to the said respondent, the same shall be decided within 3 months and no coercive step shall be taken against the petitioner for a period of 4 moths.

In the event of default on the part of petitioner, the writ petition shall stand dismissed.

Accordingly the writ petition is disposed of."

It has been brought to our notice by the petitioner that the order dated 14.12.2004 has been complied with but in spite of this fact, the representation of the petitioner filed on 16.2.2005 is still pending. Now they have issued a recovery certificate. In these circumstances, we hope and trust that the representation filed by the petitioner shall be decided within a month.

Till the decision of the representation of the petitioner, no recovery action shall be taken against the petitioner.

With the aforesaid directions the writ petition is disposed of.

Let a certified copy of this order be issued to the learned counsel for the parties within 24 hours on payment of usual charges.
