Heard learned counsel for the applicants and learned A.G.A. for the State and perused the first information report and documents on record.
It is submitted by learned counsel for the applicants that two co-accused have already been released on bail. It is further submitted that it is not a case under Section 364 I.P.C. and there is no allegation of ransom attracting the provision of Section 364 I.P.C. It is also submitted that at the maximum the case is not travelled beyond Section 342 I.P.C. and the applicants have no criminal history.
Considering the facts and circumstances of the case, I find it a fit case for grant of bail.
Let the applicants, Sirottam and Shyam Karan, shall be released on bail in Case Crime No. 421 of 2006, under Sections 364, 342 and 323 I.P.C., Police Station Kotwali, district Etawah on their each executing a personal bond and on furnishing two heavy sureties each in the like amount to the satisfaction of the court concerned.
