Hon'ble Janardan Sahai, J.

     The petitioner filed a suit in which an application for temporary injunction was also filed. The trial court issued notice on the application for temporary injunction but did not grant any ex parte temporary injunction. Ordinarily in view of the provisions of Order 39 Rule 3 Civil Procedure Code no ex parte  temporary injunction is to be granted. There is nothing to show that the discretion exercised by the trial court in not granting ex parte temporary injunction but issuing notice to the respondents to have their version suffers from any error. No ground for interference has been made out. Dismissed.
