Bhagwan Swaroop Gupta v. A.C.F. And Others - WRIT - C No. 31871 of 1993 RD-AH 13610 (7 August 2007)
Hon'ble Anjani Kumar, J.
Hon'ble Sabhajeet Yadav, J.
By means of present writ petition under Article 226 of the Constitution of India, the petitioner has challenged the order dated 9th August, 1990, passed by respondent no.1 cancelling the license of the petitioner as Stamp Vendor.
Heard learned counsel for the parties.
To us it appears that the license in question was yearly license and this Court vide its order dated 17th September, 1993 stayed the operation of the impugned order with the direction to the licensing authority to pass fresh order after giving an opportunity to the petitioner. Nothing has been brought on record as to whether the authority has passed any fresh order or not. It is also not on record that what happened after passing of the interim order by this Court. In this view of the matter, either the license in question of the petitioner has been renewed by the licensing authority or it has not been renewed. In case the petitioner's license has been renewed in that event the present writ petition has become infructuous and in the event that petitioner's license has not been renewed, the subsequent order of refusal to renew the petitioner's license has not been challenged, therefore in both the situation, to us it appears that this writ petition has become infructuous.
In view of what has been stated above, this writ petition has no force and is accordingly dismissed. The interim order, if any, stands vacated. However, there shall be no order as to costs.
