Heard counsel for the petitioners. SriAmit Sinha appeared for the respondents No. 1 and 2. Learned standing counsel appears for respondents No. 3 and 6. Issue notice to respondents No. 4 and 5. Steps for service be taken within one week.
Learned counsel for the petitioners submits that the petitioners were appointed in the institution respondent no. 4 under a Scheme of the Central Government known as " Assess with equity" . Under the said Scheme a project has been undertaken for the respondent no. 4 Institution. Under the orders of the Central Government the petitioners were engaged on contract basis on the monthly fixed salary of Rs.5000/-. The petitioners' grievance is that they are working but have not been paid their salary from June, 2005. It is submitted that the Principal respondent no. 4 Institution has already written a letter dated 23.12.2006 to Deputy Secretary, Ministry of Human Resources Development, Government of India, Secondary Higher Education, Shastri Bhawan, New Delhi praying for necessary direction regarding payment of emoluments to the teachers.
Respondents are allowed eight weeks' time to file counter affidavit. The Principal of the Institution having already written letter dated 23.12.2006 to the Deputy Secretary as noted above,the said letter be considered and appropriate decision be taken within a period of eight weeks.
List after expiry of aforesaid period.
