Lakshman Prasad Sharma v. State Of U.P. And Others - WRIT - A No. 35387 of 2007 RD-AH 13645 (7 August 2007)
Hon'ble Ashok Bhushan, J.
Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for mandamus commanding the respondent no. 3 to issue the order of approval to selected candidates. The District Inspector of Schools by the order dated 20.5.2006 granted permission to the Principal to make selection on four posts of class IV employees after following the rules of reservation. The Principal held certain proceedings but on receiving certain complaints the District Inspector of Schools by order dated 12.7.2006 has stayed his earlier permission. The Principal thereafter by letter dated 2.12.2006 prayed for recall of the order dated 12.7.2006 and it appears that certain appointment letters dated 30.12.2006 had been issued to the selected candidates. The Principal submitted letter dated 11.1.2007 prayer for approval of Class IV employees which is said to be pending. Sincere there is no approval of the selected candidates, there was no occasion for issuing any appointment letter and claim of payment of salary. Learned counsel for the petitioner has submitted that matter is pending before the District Inspector of Schools. It is for the District Inspector of Schools to consider as to whether sufficient grounds made out for recall of the order dated 12.7.2006. It is also for the District Inspector of Schools to consider and take appropriate decision in the matter relating to approval of selected candidates. No relief as prayed for in the writ petition can be granted.
Subject to above the writ petition is disposed of.
