Heard counsel for the petitioner.  Sri Veer Singh has accepted notice on behalf of respondent no. 6. Sri Anuj Kumar has accepted notice on behalf of respondent no. 4. Learned standing counsel appears for respondents No. 1 to 3.  No notice is being issued to respondent no.5.  Liberty is reserved to the respondents No. 5  to move an application for revocation, clarification, variation and modification  of  the order  if they feel so aggrieved.

By this writ petition the petitioner has prayed for quashing the select list dated 12.7.2007 by which the respondent 5 has been selected as Shiksha Mitra.  Petitioner's case in the writ petition is that the petitioner has applied in response to the advertisement  for appointment as Shiksha Mitra.  Petitioner's case is that the respondent no. 5 has illegally been selected because he was under age. The petitioner having already represented the matter  to be District Magistrate, ends of justice be served in disposing of the writ petition directing the District Magistrate to consider  and take appropriate decision on the representation dated 16.7.2007 Annexure-6 to the writ petition after giving opportunity to respondent no. 5 in accordance with law.  The said decision shall be taken expeditiously preferably within a period of three months from the date of production of a certified copy of this order .

With the above observations the writ petition is disposed of.
