Sheela Devi v. State Of U.P. And Others - WRIT - A No. 35566 of 2007 RD-AH 13687 (7 August 2007)
Hon'ble Ashok Bhushan, J.
Heard counsel for the petitioner. Sri K. S. Kushwah has appeared for the respondent no. 6. Sri Anuj Kumar has accepted notice on behalf of respondent no. 4. No notice is being issued to respondent no. 5. Liberty is reserved to the respondents No.5 to move an application for revocation, clarification, variation and modification of the order if they feel so aggrieved.
By this writ petition the petitioner has prayed for quashing the selection of respondent no. 5 published on 12.7.2007. Petitioner's case in the writ petition is that the petitioner's tenure as Anudeshak is longer than respondent no. 5 hence he was entitled for selection. Be that as it may, according to Government order dated 2.5.2006 all grievances regarding selection of Shiksha Mitra are to be first addressed to the District Magistrate. It is open for the petitioner to submit a representation to the District Magistrate. In case any such representation is submitted the same may be considered and decided expeditiously preferably with two weeks after giving opportunity to the respondent no. 5.
With the above observation the writ petition is disposed of.
