It is submitted by the petitioners' counsel that Mohd.Abir Khan who is said to have made an oral gift of the property to the defendants was found to be of unsound mind by the order dated 17.4.04  of the trial court, which was affirmed the revision and the court below has erred in recording a contrary finding that he was not of unsound mind.

Sri M.S.Haq represents respondents 1 and 2. He prays for and is granted two weeks' time to file counter affidavit The petitioner will have three weeks thereafter to file rejoinder affidavit.

Issue notice to respondent no.3.

Until the date of next listing the respondents are restrained from demolishing the property in dispute and from transferring the property.
