Prayer for bail has been made on behalf of appellant Rajendra Kumar, who has been convicted by the judgment and order dated 23.02.2007 passed by Additional Sessions Judge, Court No. 2 Bareilly, District Bareilly in S.T. No. 342 of 2004, under sections 302 IPC.
Heard learned counsel for the appellant-accused and learned AGA for the State-respondent and perused the record and judgment of Sessions Judge.
The occurrence took place at about 5.40 p.m. The complainant was standing in front of the house when the appellant armed with gun came and fired upon the deceased. Prompt FIR of the occurrence has also been lodged.
Considering the facts and circumstance of the case, nature of allegation, statement of eye witnesses, and postmortem examination report, we are of the opinion that the appellant is not entitled for bail.
The prayer for bail is accordingly rejected.
