Prayer for bail has been made on behalf of the appellant who has been convicted for life imprisonment under Section 302 I.P.C. vide judgment and order dated 30.4.2005 passed in S.T. No.927/1998 by Additional Sessions Judge, Court No. 3, Moradabad.
Heard learned counsel for the appellant and learned A.G.A. for the State and perused the lower court record as well as the order of Sessions Judge.
Learned counsel for the appellant submits that the role of firing was assigned to the appellant. The firearm injury is on non vital parts of the deceased. According to the prosecution case, after sustaining the firearm injury the deceased fell down and he has been beaten mercilessly by Lathiwalas. The other co-accused persons, who were alleged to be armed with Lathi, have already been released on bail. The appellant is in jail for more than 2 years after his conviction. Considering the facts and circumstances of the case, the appellant is admitted to bail.
Pending appeal the appellant Ram Autar @ Fakira convicted in S.T. No. 927/1998 shall be released on bail on his executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
