Heard learned counsel for the petitioner Sri Mayank Agrawal and the learned counsel for the respondents Sri Ranjeet Saxena.

The appeal was filed before the Chief Engineer, Agra Division, Agra. The same has been dismissed by the order-dated 30.8.2006 on the ground that it is not maintainable. The petitioner has to approach respondent no.4, Commissioner, Agra Division, Agra.

In view of the aforesaid fact, we direct the petitioner to file an appeal before respondent no.4 within two weeks which shall be decided by the respondent by a speaking and reasoned order perfectly according to law within a period of six weeks thereafter.

Till the decision of the appeal, no coercive steps be taken against the petitioner.

With the aforesaid directions the writ petition is disposed of. No order as to costs.
