The only prayer pressed by the counsel for the petitioner is that the appellate  court be directed to dispose of misc. appeal filed by respondent expeditiously and within a time bound period. It is stated that the respondent who has filed the appeal is delaying the proceedings. It is stated that the petitioner is an old man of about 76 years. In the facts and circumstances, as the appeal is pending since 2003, it is appropriate that the appeal may be disposed of within a period of six months form the date a certified copy of this order is filed by the petitioner before the lower appellate court.

With these direction, this petition is disposed of.
