The petitioner is Asstt. Teacher and was suspended by the order dated 21.9.2002 passed by District Basic Shiksha Adhikari Jhansi. His suspension has been revoked and thereafter the petitioner has joined his duties on 11.8.2005 at the original place of posting at Prathamik Vidhyalaya Bhajhera, Block Chirgaon District Jhansi and regular salary is being paid to the petitioner but arrears of the salary during suspension period has not been paid. In this regard the petitioner has made a representation to the Secretary Basic Shiksha Parishad. The same has not been decided.
I have heard learned counsel for the petitioner, learned Standing Counsel, and Sri Rajesh Yadav learned counsel for the respondents.
In the circumstances of the case,the petitioner may file a representation before respondent No.3. In case any such representation is filed, it may be decided by respondent No.3 by a speaking order, if possible, within two months from the date of receipt of the representation. The petitioner will file certified copy of this order, other necessary documents and a duly stamped self-addressed envelope along with the representation. The respondent No.3 after taking decision will communicate the same to the petitioner.
With these observations, the writ petition is disposed of.
