Heard learned counsel for the petitioner, learned AGA for the State and perused the record.
It is contended by the learned counsel for the petitioner that in erroneous belief the present writ petition has been filed against the order passed by the Addl. District Magistrate concerned under Section 3 of the U.P. Control of Goondas Act 1970 whereas the order is appealable to the Commissioner. He submits that he does not want to press the writ petition.
Consequently the petition is dismissed as withdrawn.
The relevant documents annexed with this writ petition shall be handed over to the learned counsel for the petitioner forthwith, so as to enable to take other legal recourse permissible under the law.
