Sri Nipun Singh, learned counsel for the respondents prays for and is granted three days time to file counter affidavit. The petitioner will have one week thereafter to file a rejoinder affidavit.
It is submitted by Sri Anil Tewari, learned counsel for the petitioners that by order dated 29.5.2007 the trial court has directed the petitioner to execute a sale deed in respect of Shop No. G-7 and G-8 in favour of the respondent. It is stated that these two shops are not even in existence as they have not even been constructed and they are to be constructed on the place, which is in possession of the respondent and unless the possession is given to the development authority the construction is not possible.
In the circumstances the direction in the order that the petitioner will execute the sale deed in favour of the respondent is stayed until the date of next listing.
