HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Anjani Kumar, J.

Hon'ble Sabhajeet Yadav, J.

Heard Sri Pramod Kumar Srivastava, learned counsel for the petitioner and the learned Standing Counsel, who has accepted notice on behalf of respondents 1 to 4 as well as Sri Nripendra Misra, learned counsel for respondent no.5.

To us, it appears that the petitioners have an alternative remedy against the sale proclamation by filing objection before the concerned Divisional Commissioner under the provisions of Rule 285 I of the U.P. Zamindari Abolition and Land Reforms Rules.

In this view of the matter, without entering into the merits or otherwise of the petitioners' case, this writ petition is dismissed against the sale proclamation on the ground of availability of alternative remedy.

Dated: 14.08.2007.
