List revised. Heard Sri Avinash Swarup, learned counsel appears on behalf of the petitioner. No one appears on behalf of the respondent.
By means of the present application petitioner has sought modification of the order dated 14.07.2006. It is submitted that by the interim order dated 19.06.2004 this Court has directed the petitioner to deposit the entire amount awarded by the Industrial Tribunal, Agra. In pursuance thereof, a sum of Rs.3,15,600/- has been deposited by the petitioner in the Treasury of the High Court and the same is still lying with the Registrar General of the High Court. This Court has allowed the aforesaid writ petition vide order dated 14.07.2006 and the award has been set aside. Petitioner is entitled for the return of the amount deposited in pursuance of the interim order dated 19.06.2004.
In view of the aforesaid facts, order dated 14.07.2006 requires modification. In the last paragraph of order dated 14.07.2006 following may be added:
"The amount Rs.3,15,600/- deposited by the petitioner in view of the interim order dated 19.06.2004, which is still lying in the form of F.D.R. No.955758 dated 23.02.2004 with the Registrar General, High Court may be returned to the petitioner alongwith interest accrued thereon."
With the aforesaid modification, application stand disposed of.
