Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. was lodged against four persons. The applicant is not named in the F.I.R. but the persons who were accused have been exonerated by the I.O. during investigation. The applicant and other co-accused have been implicated in the present case. The naming of the applicant is after thought. The co-accused Pradeep has been released on bail by this court on 17.11.2006 in criminal misc. bail application no. 25051 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Mahendra
involved in case crime no. 115 of 2006 under Sections364,302,201,120-B I.P.C.,P.S. Garhmukteshwar District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
