Learned Standing counsel has accepted notice on behalf of respondents no. 1 to 4. Sri V.K. Singh, Advocate has accepted notice no behalf of respondent no. 5. Sri P. K. Srivastava, Advocate has accepted notice on behalf of respondent no. 6.
Each one of the respondents is granted six weeks time to file counter affidavit. Rejoinder affidavit may be filed within next two weeks.
Primafacie this is glaring case of fraud and manipulation. Record in question reflects that respondent no. 6 had appeared in High School examination in the year 1998 and for the first time his date of birth mentioned in the High School cross sheet is 21.02.1984, document to this effect has been filed at page 40 of the paper book and thereafter same incumbent again appeared in the High School examination in the year 2000 and this time most surprisingly his date of birth mentioned in the High School cross sheet is 21.07.1986. Thereafter he appeared in the Intermediate examination in the year 2002 and he again appeared in the Intermediate examination in the year 2006. All these important aspect of the matter has been totally ignored by the authority concerned at the point of time when appointment has been offered to him. Once appointment has been sought to be offered to Sarvesh Kumar Maurya, respondent no. 6 the authority concerned ought to have made inquiry which is required.
Let Educational authority shall filed detail counter affidavit to this effect before this Court and till the next date of listing Sarvesh Kumar Maurya, respondent no. 6 shall be restrained from performing and discharging duties as Panchayat Mitra.
