Heard counsel for the petitioner. Sri Anuj Kumar appears for respondents No. 3. Sri C. K. Rai has put in appearance for respondent no. 4. Learned standing counsel appears for respondents No. 1 and 2.
By this writ petition the petitioner has prayed for mandamus commanding the respondents No. 2 and 3 to permit the petitioner to join again as Shiksha Mitra in Primary Vidyalay Katara, Mirzapur, Village Deoghat, District Mirzapur. Petitioner's case in the writ petition is that he was selected as Shiksha Mitra for the year 2003-2004 and worked upto 2006 Thereafter he was selected for B. Ed. course and has completed his B. Ed. Thereafter the petitioner has again come and prayed to rejoin on the post of Shiksha Mitra. The petitioner having been selected for B. Ed. and having left the post of Shiksha Mitra to complete the B. Ed., has no occasion for rejoining. The selection of Shiksha Mitra is basically for one academic year subject to renewal. The petitioner having left the job and complete one year's course of B. Ed. there is no entitlement of the petitioner to rejoin. It is open for the petitioner to make an application as and when fresh selection is made for Shiksha Mitra and his candidature may also be considered.
With the above observations the writ petition is dismissed.
