Pursuant to the order dated 3.8.2007, the case is listed today.

Sri A.K.Goel, learned counsel for the petitioner and Sri U.C. Keserwani, learned counsel for the respondent -company , are present.

In paragraph no. 10 of the Company Petition, it was, interalia, stated that an amount of Rs.8,05,956.00 was due to the petitioner from the respondent -company on the basis of the Balance-Sheet as at 31.3.2005.

As noted in the  order dated 20.4.2007, the entire amount of Rs. 8,05,956.00 , as mentioned above, stood paid to the petitioner by the respondent -company on 20.4.2007  when the entire balance amount of Rs. 6,05,956/- was paid by  Cheque tendered by Sri U.C. Keserwani,  learned counsel for the respondent -company to Sri A.K. Goel, learned counsel for the petitioner ,before the Court.

However, as noted in the said order dated 20.4.2007, Sri A.K.Goel, learned counsel for the petitioner submitted that the said amount of Rs.8,05,956.00 was shown as due on the basis of the Balance -Sheet as at 31.3.2005, and the said amount must have increased as more than three years had passed since  31.3.2005.

The said submission made by Sri A.K.Goel, learned counsel for the petitioner is to be considered today.

In view of the said submission made by Sri A.K.Goel, learned counsel for the petitioner , Sri U.C. Keserwani, learned counsel for the respondent -company has tendered today a Cheque bearing No. 088529, dated 17.8.2007,  drawn on Allahabad Bank, for  a sum of Rs. 1,91,190.00  to Sri A.K.Goel, learned counsel for the petitioner.

Sri U.C. Keserwani, learned counsel for the respondent -company submits that the said amount of Rs. 1,91,190.00 representing the entire amount of interest till date, has been paid ,  and no further amount remains to be paid to the petitioner by the respondent -company.

Sri A.K. Goel, learned counsel for the petitioner has acknowledged   the receipt of the said Cheque for Rs.1,91,190.00.

Sri A.K. Goel, learned counsel for the petitioner prays that this case may be directed to be listed on 31.8.2007 so as to enable him to obtain instructions in the matter.

The case is , accordingly, directed to be listed on 31.8.2007.
