Heard counsel for the petitioner. Sri Sanjay Kumar Singh has put in appearance for respondents No. 2, 3 and 5. No notice is being issued to respondent no. 4 in view of the order which is being passed. Counsel for the petitioner parties have agreed to finally dispose of this writ petition.
By this writ petition the petitioner has prayed for mandamus directing the respondents to release the pension, leave encashment, provident fund, gratuity etc. The petitioner's case in the writ petition is that the petitioner who was working as Office Superintendent in the University, retired on 31st January, 2007. An application was given by the petitioner on 20th March, 2007 to the Registrar praying for payment of his retiral benefits. Petitioner's case is that no retiral benefits have yet been paid although more than six months have passed.
Considering the fact that no retiral benefits has yet been paid to the petitioner, no useful purpose will be served in keeping the writ petition pending and calling counter affidavit. Ends of justice be served in disposing of the writ petition directing the Registrar to consider and take appropriate decision for payment of retiral benefits to the petitioner expeditiously preferably within a period of two months from the date of production of a certified copy of this order.
With the above observations the writ petition is disposed of.
