Faiyaj Khan v. Alauddin - WRIT - C No. 38782 of 2007  RD-AH 14230 (20 August 2007)
Against an order regarding valuation of the suit, a revision filed by the defendant respondent has been allowed and the case has been remanded to the trial court for fresh decision on the question of valuation. It has been contended that the manner of valuation of the constructions has not been given by the trial court. The view taken appears to be correct. The order does snot suffer from any illegality which may call for interference. It is open to the petitioner to put forth his version before the trial court itself.
It was then submitted by the petitioner's counsel that the trial court be directed to decide the suit expeditiously. In the facts and circumstances the trial court shall try to dispose of the suit which is said to be of the year 1998 expeditiously. Subject to this direction, the writ petition is dismissed.
