Rajendra Prasad Nayak v. State Of U.P. & Others - CRIMINAL MISC. WRIT PETITION No. 11946 of 2007 [2007] RD-AH 14314 (21 August 2007)
|
Hon'ble Sushil Harkauli, J.
Hon'ble K.N. Ojha, J.
Reliance has been placed by way of defence, upon photocopy at page 21-A of the writ petition. The document is not believable because of inherent suspicion caused by noting of "155.15" below the name of the dealer, where as no such quantity of food-grain is mentioned under any other dealer's name. This prima facie seems to be a case of interpolation by the petitioner for creating defence.
In the circumstances, we are not inclined to interfere in this case. The writ petition is accordingly dismissed.
A copy of this order will be sent by the learned A.G.A. to the Investigating Officer for consideration during investigation. The copy may be supplied free of charge within 3 days.
