This writ petition has been filed by the petitioner with the following prayers:
A) Issue a writ order or direction in the nature of mandamus commanding the respondent no.2 to decide the representation of the petitioner dated 10.12.2002(Annexure-8) to this writ petition by passing speaking and reasoned order within stipulated period as fixed by this Hon'ble Court.
B) Issue a writ, order or direction in the nature of mandamus commanding the respondents 2and 3 to pay the outstanding salary as well as arrears from Feb.1991 to Nov.1992 along with 15% compound interest in accordance with law to the petitioner within stipulated period as fixed by this Hon'ble Court.
C) issue any other suitable writ, order or direction, as this Hon'ble Court may deem fit and proper to meet the ends of justice.
D) Award cost of the petition through- out in favour of the petitioner.
The counsel for the petitioner submits that for redressal of his grievance he has already given a representation on 10.12.2002 to the DIOS but the same has not been decided. Hence the present writ petition.
I have learned counsel for the petitioner and learned Standing Counsel for the respondents.
In the circumstances of the case,the petitioner may file a representation before respondent No.2. In case any such representation is filed, it may be decided by respondent No.2 by a speaking order, if possible, within two months from the date of receipt of the representation. The petitioner will file certified copy of this order, other necessary documents and a duly stamped self-addressed envelope along with the representation. The respondent No.2 after taking decision will communicate the same to the petitioner.
With these observations, the writ petition is disposed of.
