Heard learned counsel for the petitioner as well as learned Standing Counsel and Sri P.D. Tripathi appearing for the respondents.
The contention of the petitioner is that her claim for the post of Shiksha Mitra has been ignored, policy formulated for the said purpose has been breached and Shishu Pal Singh, Respondent no. 4 has been accommodated in contravention of the policy formulated.
The grievance which is sought to be raised can be very well looked into and examined by the District Magistrate, who happens to be the Chairman of District Selection Committee by virtue of Government Order dated 2.5.2006 and is competent authority to deal with any question which arises in the matter of selection and appointment of Shiksha Mitra. As such liberty is given to the petitioner to represent the matter before the District Magistrate, along with a certified copy of this order within three weeks from today. In the event of any such representation being made, the said authority shall proceed to look into the grievance of the petitioner and take appropriate decision, in accordance with law, by means of reasoned and speaking order, within next eight weeks, after affording opportunity of hearing to the petitioner as well as Shishu Pal Singh, Respondent no. 4, and the decision so taken be communicated to the petitioner as well as Shishu Pal Singh, Respondent no. 6.
In terms of above observation and direction, this writ petition is disposed of.
