HIGH COURT OF JUDICATURE AT ALLAHABAD
Criminal Misc. Writ Petition No. 12765 of 2007
Raja Ram and another Vs. State of U.P. and others
Hon'ble S. Rafat Alam, J.
Hon'ble V.D.Chaturvedi, J.
We have heard learned counsel for the petitioners and the learned standing counsel for the State-respondents and also perused the impugned FIR.
The allegation made in the impugned FIR prima facie discloses commission of cognizable offence and, therefore, the same cannot be interfered with at this stage.
The writ petition is, accordingly, dismissed in limine. It would, however, be open to the petitioners to apply for bail before the court concerned in Case Crime No. 192 of 2007, under Sections 363 and 366 IPC, Police Station Rasoolabad, District Kanpur Dehat.
